When a judgment of not guilty is entered, the defendant, if in custody, shall be immediately discharged unless the defendant is in custody on some other charge. If the defendant is at large on bail, the defendant’s sureties shall be exonerated and, if money or bonds have been deposited as bail, the money or bonds shall be refunded.
RULE 3.690. JUDGMENT OF NOT GUILTY; DEFENDANT DISCHARGED AND SURETIES EXONERATED
- If found not guilty, a defendant in custody must be immediately discharged (unless held on other charges).
- If the defendant was out on bail, the bail bond company and its sureties are released from their obligation.
- If money or property was posted for bail, it must be refunded to the person who posted it.
