RULE 3.630. SENTENCE BEFORE OR AFTER MOTION FILED

  • The court has discretion to sentence a defendant either before or after a motion for new trial has been filed and argued.
  • A defendant does not have the right to delay sentencing until after their post-trial motions have been heard and ruled upon.

The court in its discretion may sentence the defendant either before or after the filing of a motion for new trial or arrest of judgment.
