On the trial of 2 or more defendants jointly the jurors may render a verdict as to any defendant in regard to whom the jurors agree.
RULE 3.520. VERDICT IN CASE OF JOINT DEFENDANTS
- This rule applies when multiple defendants are tried together.
- The jury can return a verdict for one defendant even if they are still deliberating or are deadlocked on another.
- This allows the court to accept a valid verdict for one co-defendant without forcing a mistrial for everyone if the jury cannot agree on others.
