RULE 3.500. VERDICT OF GUILTY WHERE MORE THAN ONE COUNT

  • This rule applies when a defendant is tried on multiple charges (counts) at the same time.
  • If the jury convicts, their verdict must specify on which count(s) they find the defendant guilty.
  • In practice, this is handled with a verdict form that lists each charge separately, requiring the jury to render a distinct verdict for each one.

If different offenses are charged in the indictment or information on which the defendant is tried, the jurors shall, if they convict the defendant, make it appear by their verdict on which counts or of which offenses they find the defendant guilty.
