RULE 3.391. SELECTION OF FOREPERSON OF JURY

  • The judge must instruct the jury to select one of their members to be the foreperson.
  • The selection is made by the jurors themselves; the judge does not appoint the foreperson.
  • The foreperson presides over deliberations and signs the final verdict form.
  • This simple rule ensures the jury has a designated leader to guide deliberations and act as their spokesperson to the court.

The court shall instruct the jurors to select one of their number foreperson.

1968 Adoption. This rule was inserted in order to clarify the system of selecting jury foreman.

1972 Amendment. Same as former rule 3.390.
