RULE 3.251. RIGHT TO TRIAL BY JURY

  • Every person accused of a crime has the right to a trial by jury.
  • This trial must be both "speedy" and "public."
  • The jury must be impartial, meaning it must be unbiased and decide the case only on the evidence presented.
  • The trial must be held in the county where the crime was committed. This is the basis for "venue."

In all criminal prosecutions the accused shall have the right to a speedy and public trial by an impartial jury in the county where the crime was committed.
