RULE 3.020. PURPOSE AND CONSTRUCTION

  • The ultimate goal of all criminal procedure rules is to ensure a "just determination" of every case.
  • The rules must be interpreted to promote simplicity, not to create procedural traps or overly technical arguments.
  • Fairness in administration is a co-equal goal, ensuring that the process is equitable for both the state and the defendant.
  • This rule acts as a guiding principle for interpreting all other rules; it is the "spirit" of the code that informs how judges and attorneys should apply specific procedures.

These rules are intended to provide for the just determination of every criminal proceeding. They shall be construed to secure simplicity in procedure and fairness in administration.
