Any party seeking a judgment taxing costs or attorneys’ fees, or both, shall serve a motion no later than 30 days after filing of the judgment, including a judgment of dismissal, or the service of a notice of voluntary dismissal. In the event of a default judgment, no further motions are needed if costs or attorneys’ fees, or both, were sought in the statement of claim.
This rule sets a strict deadline. If you win your case (or the case is dismissed) and you want the court to order the other side to pay your court costs or attorneys' fees, you **must** file a motion asking for them **no later than 30 days** after the judgment is filed. If you miss this deadline, you may lose your right to ask for them. The only exception is if you win by default judgment; in that case, no extra motion is needed if you already requested costs and fees in your original Statement of Claim.
